Terms of Service

1. Acceptance of These Terms and Eligibility

By accessing or using the Services, creating an account, completing the Human Coherence Assessment™, or purchasing any product, you confirm that you have read, understood, and agree to be bound by these Terms and by any documents incorporated by reference, including our Privacy Policy, Cookie Notice, Medical & Results Disclaimer, and Refund / Right-of-Withdrawal Policy.

• Age. The Services and any purchase are intended for adults. You must be at least 18 years of age to create an account, make a purchase, or enter into a contract with us. By using the Services you represent and warrant that you are 18 or older.
• Capacity. You represent that you have the legal capacity to enter into a binding agreement and that you are not barred from using the Services under the laws of your jurisdiction.
• On behalf of an organization. If you use the Services on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms.

2. Description of the Services

BioMastering provides educational and wellness content and experiences grounded in a self-development methodology described as "The Science and Practice of Human Coherence." The Services currently include, without limitation:

• Human Coherence Assessment™ — a free 30-question self-assessment and self-reflection tool;
• First Awakening™ — a one-time USD $7 digital experience delivered over 21 days, with lifetime access;
• APEIRON Protocol™ — a USD $97 90-day educational program;
• Founding Cohort™, BioMaster Circle™ membership, Certification™, and Research Fellowship™ — application-based, membership, and/or paid programs; and
• related articles, videos, downloadable or streamed materials, coaching, and community features.

All products and services are digital (courses, memberships, downloadable or streamed content, and assessments). We do not sell physical goods. We may add, modify, suspend, or discontinue any part of the Services at any time, as described in Section 15.

2.1 Delivery Through Course Creator 360 (CC360 / HighLevel)

Our courses, memberships, customer relationship management, email/SMS communications, checkout, and payment processing are hosted and delivered through Course Creator 360 ("CC360"), a white-label of GoHighLevel / HighLevel, a third-party platform. Your account, purchases, and access to course content take place on the CC360/HighLevel platform and are subject to that platform's own terms and policies in addition to these Terms. Payments are processed inside CC360/HighLevel via Stripe. We do not control, and are not responsible for, the availability, security practices, or terms of these third-party platforms; your use of them is at your own risk and subject to their agreements. How we handle data shared with these providers is described in our Privacy Policy.

3. Not Medical or Healthcare Services

BioMastering is an education and coaching company. It is not a medical or healthcare provider, and the Services are not medical, diagnostic, or treatment services. The content, the Human Coherence Assessment™, and all programs are provided for educational, informational, and general wellness purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.

• The Human Coherence Assessment™ is a self-reflection tool, not a diagnostic instrument, and its results are informational only.
• Nothing in the Services is intended to diagnose, treat, cure, or prevent any disease or health condition.
• Using the Services does not create a physician–patient, therapist–client, or any other professional healthcare relationship.
• Always seek the advice of a qualified physician or other licensed health provider before acting on anything you read or receive through the Services, and never disregard or delay seeking professional advice because of Service content.
• In an emergency, call your local emergency number (911 in the US, 112 in the EU/UK) immediately. Do not use the Services for medical emergencies.

4. Accounts and Security

• Some Services require you to register for an account on the CC360/HighLevel platform. You agree to provide accurate, current, and complete information and to keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Do not share your account or credentials.
• Notify us promptly at contact@aethermindai.net if you suspect any unauthorized use of your account.
• We are not liable for any loss arising from unauthorized use of your account resulting from your failure to safeguard your credentials.
• You may not create an account for anyone other than yourself without authorization, use another person's account, or use the Services if we have previously suspended or banned you.

5. Purchases, Pricing, Taxes, and Payment

• Currency and pricing. Prices are stated in US Dollars (USD) unless otherwise indicated. Current headline prices include First Awakening™ at USD $7 (one-time) and the APEIRON Protocol™ at USD $97 (one-time); membership and other program prices are shown at checkout. Prices may change at any time, but changes will not affect orders already placed.
• Taxes. Prices may be exclusive of applicable taxes (such as VAT, GST, or sales tax). Where we or our payment providers are required to collect such taxes, the applicable amount will be shown and/or added at checkout, and you are responsible for it.
• Payment processing. Checkout and payment occur on the CC360/HighLevel platform and are processed by Stripe. By purchasing, you also agree to the applicable terms of the platform and payment processor. You represent that you are authorized to use the payment method you provide.
• Order confirmation. Total price, currency, any recurring amounts, and applicable taxes are shown before you complete payment. Your order is confirmed when access is granted and/or a confirmation is issued on a durable medium.
• Immediate-access digital content. Because many products provide instant access to digital content, specific consumer withdrawal rules apply. See Section 6 and the Refund / Right-of-Withdrawal Policy.

6. Digital Content, Refunds, and Right of Withdrawal

Our refund terms, the EU/UK 14-day right of withdrawal for digital content, and the express consent and acknowledgement required to begin immediate access (and thereby waive that withdrawal right) are set out in full in the Refund / Right-of-Withdrawal Policy, which is incorporated into these Terms by reference. In summary:

• EU/EEA and UK consumers generally have a 14-day right of withdrawal for digital content.
• For products offering immediate access (such as First Awakening™ and the APEIRON Protocol™), you will be asked at checkout to expressly consent to immediate performance and to acknowledge that you thereby lose your 14-day right of withdrawal once access begins.
• Any refund guarantees, conditions, and our chargeback posture are described in the Refund / Right-of-Withdrawal Policy. We ask that you contact us at invoice@aethermindai.net before initiating a chargeback so we can resolve the issue directly; chargeback handling is subject to Stripe dispute terms.

7. Memberships and Automatic Renewal

Certain Services — including the BioMaster Circle™ membership — are offered on a recurring subscription basis. The following terms apply and are presented clearly and conspicuously before you subscribe, with your affirmative consent obtained at checkout:

• Automatic renewal. Your subscription will automatically renew at the end of each billing period (e.g., monthly or annually, as selected) and your payment method on file will be charged the then-current renewal price, until you cancel.
• Renewal price and frequency. The recurring amount, billing frequency, and renewal date are disclosed at checkout and in your purchase confirmation.
• How to cancel. You may cancel at any time, effective at the end of the current billing period, through your account settings on the CC360/HighLevel platform ("click to cancel") or by emailing contact@aethermindai.net. Cancellation stops future renewals; it does not, by itself, entitle you to a refund of amounts already charged except as stated in the Refund / Right-of-Withdrawal Policy.
• Reminders and confirmation. We will send a post-purchase confirmation of your subscription terms and, where required, renewal or price-change reminders.
• Consumer protections. These terms are intended to comply with the California Automatic Renewal Law (ARL), US FTC negative-option rules, and EU/UK auto-renewal transparency requirements. Nothing here limits any non-waivable auto-renewal cancellation rights you have under your local law.

8. License to Use Content; Intellectual Property

Our ownership.

The Services and all content, materials, and features — including text, graphics, video, audio, course materials, assessments, methodologies, look and feel, and software — and all trademarks, logos, and brand names, including BioMastering™, Human Coherence Assessment™, First Awakening™, APEIRON Protocol™, Founding Cohort™, BioMaster Circle™, Certification™, Research Fellowship™, and associated marks, are owned by or licensed to Aethermind AI LLC and are protected by intellectual property laws. All rights not expressly granted are reserved.

Your license.

Subject to these Terms and your payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the content you have purchased or been granted access to, solely for your own personal, non-commercial self-development.

Prohibited uses.

You may not: copy, reproduce, republish, distribute, resell, sublicense, rent, lease, lend, or share access to any content or account; share paid materials with non-purchasers; download or scrape content except as expressly permitted; create derivative works; remove proprietary notices; use the Services or content to build a competing product; use any automated means to access the Services; reverse engineer any software; or use the Services in any unlawful, infringing, harassing, or harmful manner.

Any use of our trademarks requires our prior written permission.

9. User Content and Testimonials

Your content.

You may have the opportunity to submit content, such as comments, community posts, feedback, testimonials, or reviews ("User Content"). You retain ownership of your User Content.

License to us.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual license to use, reproduce, adapt, publish, display, and distribute that User Content in connection with operating and marketing the Services. Where we use a testimonial with your name, image, or likeness, you consent to that use; you may withdraw consent for future use by contacting contact@aethermindai.net.

Your responsibility.

You represent that you own or have the rights to your User Content, that it is truthful and reflects your honest experience, and that it does not infringe any third-party rights or violate any law. Do not post health information about others, unlawful, defamatory, or infringing material.

Results disclosure.

Testimonials reflect individual experiences and are not a guarantee of results. Results are not typical and individual results vary. See Section 11 and the Medical & Results Disclaimer.

Moderation.

We may, but are not obligated to, review, refuse, or remove User Content at our discretion.

10. Communications Consent (Email and SMS)

Where you opt in, we may send you marketing and transactional communications by email and/or SMS. Marketing consent is obtained separately from purchase and is not a condition of purchase. For SMS, message frequency varies, message and data rates may apply, and you can reply STOP to opt out or HELP for help. You can unsubscribe from marketing emails at any time via the unsubscribe link. Details of how we handle your communications and consent are in our Privacy Policy.

11. Disclaimers of Warranties; No Results Guarantee

The Services and all content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage.

• We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any content is accurate, complete, or current.
• No results guarantee. We make no guarantee of any specific outcome, result, health, wellness, longevity, or "regeneration" benefit. Any examples or testimonials are illustrative only; results are not typical and individual results vary. Your outcomes depend on many factors outside our control.
• The Services are educational and are not medical advice, as stated in Section 3 and the Medical & Results Disclaimer.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Nothing in these Terms excludes or limits any rights or statutory guarantees that cannot be excluded under applicable mandatory consumer-protection law.

12. Limitation of Liability

To the fullest extent permitted by applicable law:

• We and our officers, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Services.
• Our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the total amount you paid to us for the Services giving rise to the claim in the 12 months before the event, or (b) USD $100.
• We are not liable for the acts, omissions, availability, or security of third-party platforms and processors, including CC360/HighLevel and Stripe, or for third-party websites linked from the Services.

These limitations do not apply to liability that cannot be limited or excluded under applicable law (for example, liability for death or personal injury caused by negligence, fraud, or, for EU/UK consumers, non-waivable statutory rights). If you are a consumer, you retain all mandatory protections of your local law, and nothing here deprives you of them.

13. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Aethermind AI LLC and its affiliates, officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Services; (c) your User Content; or (d) your violation of any law or the rights of a third party. This Section does not apply to the extent a claim arises from our own wrongdoing, and it does not limit your non-waivable consumer rights.

14. Third-Party Links and Services

The Services may contain links to, or integrations with, third-party websites, platforms, and services (including CC360/HighLevel, Stripe, and others). We do not control and are not responsible for their content, products, privacy practices, or terms. Accessing them is at your own risk and subject to their agreements.

15. Suspension and Termination

• You may stop using the Services at any time and may cancel any subscription as described in Section 7.
• We may suspend or terminate your access to all or part of the Services, with or without notice, if you breach these Terms, misuse the Services, or where required by law or to protect the Services or other users.
• Upon termination, your license to access purchased content ends, subject to any non-waivable consumer rights and the terms of the Refund / Right-of-Withdrawal Policy. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

16. Governing Law and Dispute Resolution

Governing law.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.

Consumer protections preserved.

If you are a consumer resident in the EU/EEA or the UK, this choice of law does not deprive you of the protection of the mandatory consumer-protection provisions of the law of your country of residence, and you may bring proceedings in your local courts where your local law so provides.

EU Online Dispute Resolution.

EU consumers may access the European Commission's Online Dispute Resolution (ODR) platform. Note: the EU ODR platform is being phased out; where it is unavailable, please contact us directly at contact@aethermindai.net to seek resolution, and you may also use a competent alternative dispute resolution body or your local consumer authority.

Informal resolution.

Before starting any formal proceeding, please contact us at contact@aethermindai.net so we can try to resolve the matter.

17. Changes to the Services and to These Terms

We may modify the Services or these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Changes are effective when posted, except that changes affecting your existing subscription or purchased content will not apply retroactively where prohibited by law and, where required, we will seek your consent. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

18. General

• Entire agreement. These Terms, together with the documents incorporated by reference, are the entire agreement between you and us regarding the Services.
• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
• No waiver. Our failure to enforce any provision is not a waiver of it.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
